La Cruz Marina Controversy Continues

Ray Dion flew over La Cruz last week to give us a closer look at the changes that are taking place on the La Cruz de Huanacaxtle coastline.
Puerto Vallarta - Once a tranquil and picturesque fishing village on Banderas Bay, today La Cruz de Huanacaxtle, Nayarit is a hotbed of controversy. As you are reading this, a marina developer, the La Cruz Yacht Club (CYC), is filling in the bay in front of Mexican, Canadian and American homeowners' properties by importing landfill and erecting a levee approximately 80 meters out into the ocean.

Though construction of the marina was originally designed to take only the beach in the village’s harbor, the CYC extended their plans to include two more sections of beach, directly in front of the homeowners properties. Having paid to live directly on the waterfront, homeowners are angered by the developer's attempts to create new beachfront property - and eventual structures - in front of their homes.

And in this case, it doesn't seem to matter that the homeowners have all the proper documentation of ownership to their waterfront properties as stated in their escrituras (titles) and have been paying their Zona Federal, which authorizes their usage of the waterfront, for years.

"Our discovery process has revealed that the marina developer does not have the authorization or permits to build in front of our members," said the CCC’S attorney Ernesto Uzcanga. "Anyone who suggests the work being done in constructing the La Cruz Marina is legal is absolutely wrong," he added.

CCC attorneys have filed accusations of illegal construction with the national offices of PROFEPA, SEMARNAT and SCyT. They have also filed criminal actions against the developer in Superior Criminal Court, charging CYC, its lawyers and its investors with criminal violations of federal laws. But so far little relief has come from officials, and in the meantime, construction continues.

Home owner Douglas Davies had this to say, "We are utterly frustrated that despite the fact we have shown illegality and have our own papers in order, the construction continues daily in front of our homes, creating an environmental disaster zone and devaluing our properties substantially."
