Lazaro Cardenas Parking Garage Postponed Grupo Ecologic Puerto Vallarta
| Tecnologia en Proyectos Inmobiliarios did not comply with the ecological requirements contained in the Environmental Impact Report, which would not permit the cutting of the large parota trees in the park. | Puerto Vallarta - On Friday, April 7, 2006, the legal representative of the Municipal Government of Puerto Vallarta, Lic. Miguel Angel Yerena Ruiz, announced that Tecnologia en Proyectos Inmobiliarios, S.A. de C.V., the construction company which was awarded the bid to construct parking structures in Plaza Pitillal and Parque Lazaro Cardenas in February of this year, had withdrawn from the construction in Parque Lazaro Cardenas.
This announcement, apparently, was only revealed to the city council within the past days and was only known to the mayor and the legal representative before.
The legal representative stated that a new bid process would be initiated to engage another company to proceed with the construction of the parking structure in Parque Lazaro Cardenas. There are various companies which have expressed an interest, stated the legal representative.
Tecnologia en Proyectos Inmobiliarios, S.A. de C.V., the article states, did not comply with the ecological requirements contained in the Environmental Impact Report, which, among other points, would not permit the cutting of the large parota trees in the park. The company will continue with the construction of Plaza Pitillal which was begun in February of this year. Apparently, there was no deposit made by Tecnologia when they were awarded the construction contract for Parque Lazaro Cardenas.
NOTE: Grupo Ecologico de Puerto Vallarta, A.C. filed a Denuncia Popular with the respective authorities on March 17, 2006 after obtaining a copy of the Environmental Impact Report on Parque Lazaro Cardenas. Even though the Grupo has legally demanded a copy of the Environmental Impact Report since January 2005 for Parque Hidalgo, no reports had been received until the Parque Lazaro Cardenas report in March of this year.
Grupo Ecologico de Puerto Vallarta, A.C. has argued since January of 2005 that the construction of parking structures in the city parks is illegal since the conversion of the public parks into parking structures controlled by private companies constitutes a change in the use of the land which, by law, requires a public hearing. A public hearing has never been conducted by the Municipal Government.
Consequently, the Grupo Ecologico de Puerto Vallarta, A.C. demands that Agreement No. 0453/2004, approved by the city council on 10 November 2004 and which approved the "disincorporation" of the parks, be rescinded. In this way, the last remaining park, Parque Lazaro Cardenas, could be protected and conserved in its traditional state.
The legal representative of the Municipal Government, Lic. Miguel Angel Yerena Ruiz, also announced on Friday, April 7, 2006 that Discovery PV, the company that constructed Parque Hidalgo and is currently building the parking structure in Parque Benito Juarez, has requested the city council to approve the "disincorporation" of part of Calle Morelos to be included in their parking project. This would be similar to the incorporation of Calle Argentina into the Parque Hidalgo project that occurred in August of 2005.
The city council requested information from the committee of the city government which has been charged with overseeing the project while the legal representative and the Department of Public Works have declared that they are not responsible in this matter. |
