Mexico Asks US to Respect ICJ Decision
Prensa Latina go to original
Mexico City - Mexico asked the US courts respect for the decision of the International Court of Justice on the case of 51 Mexican citizens sentenced to death in the US.
A declaration of the Mexican Foreign Affairs Ministry said it would keep on using every legal resource at its reach to revert the situation provoked by the US Supreme Court when it ratified death penalty for Mexican citizen Jose Ernesto Medellin.
Such a decision might affect the rest of the people sentenced to death, and disregarded the decision of the International Court of Justice in the so-called Avena Case, in which ICJ ordered US to revise and reconsider the death sentences to the 51 Mexican citizens.
The defense of Medellin was based on this, because of the violations to the right of notification and consular assistance, but the US Supreme Court rejected this, and said it was not its obligation to enforce the ICJ decision.
The US Supreme Court said it was not forced to recognize the fulfilment of the ICJ decision, though it is implicit in the UN Carta Magna and the ICJ statutes, which is an aggravator. |
