1) Electoral Justice: The International IDEA Handbook and 2) Second Ibero-American Conference on Electoral Justice

1) On the Handbook: In November 2010, IDEA International (Institute for Democracy and Electoral Assistance), will present a handbook that should be the framework of how to handle Electoral Justice and how to prevent electoral disputes. What is important in this forthcoming handbook is that it will present examples from all over the world in how some specific problems have been processed, handled and solved. All of this will come from communities, regions or even countries. A very enriching summary of examples.

IDEA’s areas of expertise are (not by order of importance), a) Electoral Processes, b) Constitution Building Processes, c) Political parties, participation and representation and d) Democracy and development.

It should be kept in mind that a government can only be legitimate if an election is considered “fair” and “impartial”. If these two principles are met, there is no doubt that the government would be respected as “honest”. However, disputes might come up. A complementary electoral justice system should effectively resolve disputes in a legal framework of the corresponding constitution, legislation, regulations and international treaty obligations. This legal system gives the people (or political parties or any other groupings) who believe their electoral rights to have been violated, the ability to make a complaint, receive adjudication and an impartial decision.

An on line version of the handbook will be available on line and I will have the pleasure to provide the information to our readers once it is available.

2) On the Ibero-American Conference: The Conference was held in Panama City from 1-3 September 2010. It was convened by IDEA Intl, the Panama’s Electoral Tribunal and the Panama’s Government. Prestigious Spanish organizations also contributed to the event: particularly the Centre for Political and Constitutional Studies of Spain. I want to point out to the readers that a Mexican former Electorate Magistrate, Jesus Orozco Enriquez presented a paper: “Evolution and Perspective of Electoral Justice in Ibero-America” which was one of the key papers in the Conference.
