Two particular ompanies “which benefit from fraudulent foreclosures are Wells Fargo and Freddie Mac. Another foreclosure fraud component involves fabricated pleadings (such as false ‘lift stay motions’ and false ‘proof of claims’) that mill lawyers file in Bankruptcy courts.
Foreclosure fraud has far reaching effects on people; for example: illegitimate homelessness, unfairly answerable for IRS tax bills, and undue “deficiency judgments.”

But with corruption being so well-thought-of here in Louisiana (as boasted about on Capitol Hill at the impeachment trial of federal Judge Thomas Porteous, it’s the “Louisiana way”), and with our various State Attorney Generals’ decades of disregard for abhorrent Debt Collection practices, Louisiana firms like those mentioned below have thrived with fraudulent and deceptively foreclosures and repossessions.
For more than five (5) years, I have been blogging on the Internet about “foreclosure fraud” and “debt collection” abuses. A mere google search will bring up former years of my articles and comments posted – on the huffingtonpost, firedoglake, washingtonpost, msfraud.org, newyorktimes, motherjones, and others – about this very subject; with names of certain people involved in activities of foreclosure fraud here in Louisiana.
Today, I am really not now saying anything new – except I wish to reiterate what I have been saying ALL ALONG; what is now being repeatedly confirmed by every significant news media on the world wide web:
Foreclosure fraud is NOT limited to the definition [Freddie Mac] assigned foreclosure fraud years ago. Foreclosure fraud includes mortgage fraud! And, it is not limited to foreclosure scams. Foreclosure fraud encompasses lawyers and judges on the bench.
Approximately for the past 6 months, national media stories and news have been increasingly educating the public about fraudulent foreclosure, and its effects upon people who are in default of their home loans, as well as unpleasant outcomes for people who are not!
Emphatically, I want to say again that commercial and residential real estate foreclosures via deceptive and fraudulent proceedings –among other things– enable lenders to repeatedly, illegally flip properties; and it enables falsified IRS form 1099-A’s. Foreclosure fraud is the best means by which unscrupulous foreclosure mill lawyers deceptively hold simulated auctions and they bid (or insiders bid) and acquire those properties. This also is the reason for many blighted neighborhoods.
Foreclosure fraud deliberately utilizes defunct mortgage lenders’ companies, or companies which no longer own promissory notes. These foreclosure mill lawyers tack on huge “fees” as ransom for those properties which makes it even harder for property owners to regain their properties.
In Louisiana, two particular companies that benefit from fraudulent foreclosures are Wells Fargo and Freddie Mac; predatory foreclosure mill lawyers include the Dean Morris Law Firm, Herschel C. Adcock, Jr., and Brett P. Furr; Atty. William M. Detweiler also helped out; and judges who have purposefully abetted fraudulent foreclosures include Federal Judge Lance Africk, Federal Judge Kurt Engelhardt, Federal Judge A.J. McNamara, bankruptcy Judge Douglass Dodd,and Orleans Parish Judge Lloyd J. Medley.
Another thing to point out about Louisiana, particularly New Orleans, is the fact of blighted / abandoned properties left over from Hurricane Katrina, coupled with authority unscrupulous foreclosure mill lawyers had to carry out ‘simulated’ foreclosure auctions that resulted in property deeds being recorded out of homeowners’ names. Those properties were sometimes repeatedly flipped. Also, claims for Katrina insurance money could be made without any one looking over any one’s shoulder. It is very possible that the New Orleans Mayor has that current blight situation due to the fraudulent foreclosure conduct that was a definite New Orleans pre-Katrina reality.
Additionally, representations about Freddie Mac’s billion dollar losses should be weighed against the needless money Freddie Mac – as well as other lenders – PAY to foreclosure mills and debt collectors who utilize court systems to outmaneuver and persecute property owners who oppose unlawful foreclosures and repossessions.
When property owners file justifiable lawsuits for fraud and for OUTRAGEOUS “Unfair Debt Collection Practices” against lenders and foreclosure mills, those same mill lawyers get to make even more $$$$ from the latter lawsuits as the mill lawyers litigate and cover up their own wrongdoings.
Further, the shockingly fabricated pleadings (such as false ‘lift stay motions’ and false ‘proof of claims’) that mill lawyers file in Bankruptcy courts for fraudulent repossession of commercial and residential real estate is res ipsa loquitur demonstration of intentional foreclosure fraud – with full approval of certain federal court judges. Foreclosure fraud has many far-reaching effects for people; for example: illegitimate homelessness, unfairly answerable for IRS tax bills, and undue “deficiency judgments.”
