A Message from the Conchas Chinas Homeowners Association

The CCHA reviews all proposed construction plans to insure the plans comply with city and state regulated density, height, easements and off-street parking.
Puerto Vallarta - Last week, a landslide in Amapas was erroneously reported to have happened in Conchas Chinas. The foundation of a building was undermined by the lower abutting construction of Villas de la Colina II, causing it to slide and break apart. Fortunately, there were no fatalities.

The Board of the Conchas Chinas Homeowners Association (CCHA) has been bombarded with questions from other homeowners about this, along with renewed complaints of overbuilding in Conchas Chinas. The CCHA would like to emphatically express to its homeowners and to the public that the landslide did not occur in Conchas Chinas.

The new city administration has taken the pro-active step of asking the Governor of Jalisco to investigate all permits issued in December of 2006. So far, according to the Municipal website, some 70 projects have been identified.

While the Conchas Chinas Homeowners Association can't do anything about permits issued in other colonias, they can, and are, working with the city to stop projects that were permitted without the approval of the CCHA board.

Many Conchas Chinas homeowners and some real estate firms don't understand the CCHA involvement in the construction approval process. CCHA has a contract (Convenio) with the City, which gives CCHA the responsibility of, and the authority to, review all proposed construction plans to insure the plans comply with city and state regulated density, height, easements and off-street parking.

These determinations are made by a certified architect who advises the board. A plan review fee is charged by CCHA. Upon paying these fees and receiving the approval of CCHA, the plans can then be submitted to Planeación for city permits.

This service by the CCHA is a benefit to the project owner and builder because potential problems can be resolved prior to submission to Planeación. By discussing the project, in English or Spanish, in a relaxed atmosphere, the CCHA review can save the developers time and money, and leads to a smoother project.

The city does not maintain Conchas Chinas. The city's Convenio with CCHA guarantees homeowners that the maintenance of Conchas Chinas streets, street lighting, common area gardens and green spaces will be provided by CCHA. Fees that CCHA collects from plan reviews and annual maintenance fees are needed to provide that maintenance.

Annual Maintenance fees in Conchas Chinas, which range from $100 USD to $300 USD per year, are voluntary. Therefore, CCHA has no legal right to force homeowners to pay them. Sadly, two thirds of homeowners currently prefer to let their responsible and charitable neighbors shoulder the burden of maintaining the colonia. Larger projects intended to improve the colonia, such as new street lamps and improved entrances, await the funding that greater participation would bring.
